These Terms of Use govern your access to and use of FireRisk.ai. By using the site, you agree to them. If you don’t agree, please don’t use the site.
Informational only — not advice
FireRisk.ai provides wildfire risk information and tools for general educational purposes. Our scores, maps, simulations, and estimates are not guarantees of insurability, premium, safety, or any outcome, and are not professional, insurance, legal, financial, or engineering advice. Always verify official designations with your insurer, local fire authority, and licensed professionals, and follow official sources (e.g., Watch Duty, your fire department, and 911) for active fires and evacuations.
Data & accuracy
Information is derived from public federal and state sources and third-party services and is provided “as is.” Data may be incomplete, delayed, or contain errors, and conditions change. We don’t warrant the accuracy, completeness, or timeliness of any information, and risk varies street-to-street and over time.
Tools & documents you generate
Tools such as the Appeal Kit, Claim Toolkit, and mitigation/verification builders produce drafts to help you organize your own information. You are responsible for reviewing, verifying, and using any document. They do not create any legal right or obligation, and following them does not guarantee a discount, approval, claim payment, or appeal outcome.
Insurance & contractor referrals
When you request quotes or a match, we may connect you with third-party licensed carriers, agents, or contractors, and we may be compensated for referrals. We are not an insurer, agent, broker, adjuster, or contractor, and we do not endorse or guarantee any third party. Vet any provider yourself before engaging them.
Acceptable use
Don’t misuse the site: no scraping or bulk extraction without permission, no attempts to disrupt the service, no unlawful use, and no reliance on the site for emergency decisions.
Intellectual property
The site, content, and software are owned by FireRisk.ai or its licensors. Government data is used under public terms. You may view and share pages for personal, non-commercial use; all other rights are reserved.
Assumption of risk
Wildfire is a life-safety matter. You acknowledge that the site is an informational aid only, that you are solely responsible for decisions about your property, insurance, evacuation, and safety, and that you rely on the site entirely at your own risk. In an emergency, call 911 and follow official authorities — never the site.
Disclaimer of warranties & limitation of liability
The site is provided “as is” and “as available,” without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, accuracy, title, and non-infringement.
To the fullest extent permitted by law, FireRisk.ai and its owners, operators, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of property, data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the site or any decision made based on it — even if advised of the possibility. Our total aggregate liability for any and all claims will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; nothing here limits liability that cannot be limited by law.
Indemnification
You agree to defend, indemnify, and hold harmless FireRisk.ai and its owners, operators, employees, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the site, your violation of these terms, or your violation of any law or third-party right.
Governing law & dispute resolution
These terms are governed by the laws of the United States and the state in which FireRisk.ai is organized, without regard to conflict-of-laws rules. Any dispute arising out of or relating to the site or these terms will be resolved by binding individual arbitration or, where eligible, in small-claims court. To the extent permitted by law, you and FireRisk.ai each waive any right to a jury trial and to participate in a class, collective, or representative action. The state and federal courts at FireRisk.ai’s principal place of business have exclusive jurisdiction over any matter not subject to arbitration.
